PRIVACY POLICY Effective as of February 2, 2023 [version 2]

Limoverse Technologies LLC, a wellness web3 company duly incorporated and existing under the rules and regulations of Dubai, UAE with licence number 1082384 and having its operational offices at 201-207, Latifa Towers, Sheikh Zayed Road, Dubai, United Arab Emirates ("us", "we", "our" or "Limoverse", which also includes its affiliates) is the author and publisher of the internet resource www.limoverse.io ("Website") on the world wide web as well as the software and applications provided by us, including but not limited to the mobile application 'Limoverse' (together with the Website, referred to as the "Services" or "Platform").

This privacy policy ("Privacy Policy") explains how we collect, use, share, disclose and protect Personal Information about the Customers of our Services, including the Service Practitioners (as defined in the Terms of Use), the End-Users (as defined in the Terms of Use), and the visitors of Website or the Limoverse apps (jointly and severally referred to as "you", "your" or "Customers" in this Privacy Policy). We encourage you to take the time to review this Privacy Policy carefully, to understand what information we collect, how we collect it, why we collect it, and what we do with it.

BY USING THE SERVICES OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE PRIVACY POLICY. WE RESERVE THE RIGHT TO CHANGE, MODIFY, ADD OR DELETE PORTIONS OF THE TERMS OF THIS PRIVACY POLICY, AT OUR SOLE DISCRETION, AT ANY TIME. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY AT ANY TIME, DO NOT USE ANY OF THE SERVICES OR GIVE US ANY OF YOUR INFORMATION. IF YOU USE THE SERVICES ON BEHALF OF SOMEONE ELSE (SUCH AS YOUR CHILD) OR AN ENTITY (SUCH AS YOUR EMPLOYER), YOU REPRESENT THAT YOU ARE AUTHORISED BY SUCH INDIVIDUAL OR ENTITY TO (I) ACCEPT THIS PRIVACY POLICY ON SUCH INDIVIDUAL'S OR ENTITY'S BEHALF, AND (II) CONSENT ON BEHALF OF SUCH INDIVIDUAL OR ENTITY TO OUR COLLECTION, USE AND DISCLOSURE OF SUCH INDIVIDUAL'S OR ENTITY'S INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

NOTE: If you are a user of an application that is integrated or built using Limoverse products and services, that application's privacy policy will describe how it collects, uses, stores, and shares your data. We are not responsible for the privacy policies or actions of our third-party customer applications.

WHO WE ARE?

Limoverse is a global health and wellness eco-system built on Blockchain using Decentralised Ledger Technology. Limoverse connects wellness seekers and health and wellness providers globally. Users are empowered by highly secured Personalized Health Data using their genetic and metabolic profiles, which enables providers to offer highly personalised services for precision health care. Limoverse also connects wellness practitioners and institutions around the globe to exchange their services and ideas among themselves.

Limoverse envisions a world where every person is empowered to take charge of their own body and mind with the help of cutting-edge science and technology like personal genomics and artificial intelligence, enabling them to live a long, healthy and productive life contributing their best to society.

WHAT INFORMATION DO WE COLLECT?

Information you provide directly to us: We collect various types of information that you provide directly to us, including:

  1. Personal Identifiers: When you subscribe to our newsletters, download the app, fill up the enquiry form, register for one of our webinars, sign up for our services, or request us to contact you, we may ask for information such as:
    1. Name
    2. Birth date
    3. Postal address
    4. E-mail address
    5. Telephone number
    6. Company name
    7. Job title
  2. Payment Information: When you make purchases or transactions through our services, we collect payment details as necessary to process the transaction.
  3. Support Information: When you request support from us, we may collect additional information such as:
    1. Contact information
    2. Documentation
    3. Screenshots
    4. Other information you or we believe is helpful in resolving your issue
  4. Call Recordings: When you speak with our customer service or sales representatives on the phone, your calls may be recorded and/or monitored for quality assurance, training, and research purposes.
  5. Government-Issued ID: In certain limited circumstances, we may collect your government-issued ID number, such as:
    1. For tax reporting relating to a payment for a customer referral
    2. To facilitate an international money transfer
    3. For statutory KYC/AML compliance purposes
  6. Health and Fitness Data: Through Google Health Connect, we may collect various types of health and fitness data, including but not limited to:
    1. Active Calories Burned Record: Information about the calories you have burned through physical activity, separate from your basal metabolic rate.
    2. Distance Record: The distance you have travelled during activities such as walking, running, or cycling.
    3. Elevation Gained Record: Data on the elevation you have gained during activities, useful for tracking hikes or stair climbing.
    4. Exercise Session Record: Details about your exercise sessions, including duration, type of exercise, and intensity.
    5. Floors Climbed Record: The number of floors you have climbed, typically measured by your device's altimeter.
    6. Heart Rate Record: Your heart rate measurements over time can indicate cardiovascular health and exercise intensity.
    7. Hydration Record: Information about your fluid intake, helping you track your hydration levels.
    8. Nutrition Record: Data about your food and nutrient intake, including calories, macronutrients, and micronutrients.
    9. Oxygen Saturation Record: Measurements of the oxygen saturation level in your blood, often collected by wearable devices.
    10. Respiratory Rate Record: Your breathing rate, which can be an indicator of overall health and fitness.
    11. Resting Heart Rate Record: Your heart rate when you are at rest, an important indicator of cardiovascular health.
    12. Sleep Session Record: Information about your sleep patterns, including duration and quality of sleep.
    13. Steps Cadence Record: Data on the rhythm and frequency of your steps during activities like walking or running.
    14. Steps Record: The number of steps you have taken, a common measure of daily activity.
    15. Total Calories Burned Record: The total number of calories you have burned, including both active calories and those burned at rest.
    16. Weight Record: Your body weight measurements over time.

Information we collect automatically when you visit our websites: We and our third-party partners, such as our advertising and analytics partners, collect information about your visits to our websites and your interactions with our ads or content. This includes:

  1. Device Information:
    1. IP address
    2. Browser type and version
    3. Operating system
    4. Device identifiers
  2. Usage Information:
    1. Pages visited
    2. Time spent on pages
    3. Links clicked
    4. Referral source
  3. Location Information:
    1. General location based on IP address
    2. Precise location (if permitted by your device settings)
  4. Tracking Technologies:

    3. Pixel tags
    4. Other similar technologies

Information we get from third parties: We may obtain information about you from various third-party sources, including:

  1. Third-party services and social media:
    1. If you create an account or access our services through a third-party service (such as Facebook, Google, LinkedIn, GitHub, or Twitter), we may receive certain information from that service, such as your profile information, friends list, and public posts.
    2. We may also collect information from third-party services that are integrated with our services, such as third-party CRMs or other applications that you authorise our services to connect with.
  2. Demographic, lead, and interest data:
    1. We may obtain information from companies that collect customer information, including demographic and interest data. This may include information such as your gender, date of birth, and postal code.
    2. We use this data, combined with other information we have about you, to help predict your preferences and to direct marketing offers that might be more relevant to you.
  3. Marketing lead information: Where permitted by law, we may obtain contact information and other marketing lead information from third parties, website "invite others / refer a friend" options or social media platforms.
  4. Information about customers' users: Our customers and other third parties may provide us with personal information about our customers' users and others. This may include:
    1. Telephone numbers
    2. Telephone numbers' validity
    3. Type of phone (e.g., mobile, landline)
    4. Device status
    5. Roaming status
    6. Carrier
    7. Country of location
    8. Whether the number has been ported
  5. Communications usage information: We collect information about your communications delivered via our Platforms, such as:
    1. Time and duration of usage
    2. Source and destination identifiers
    3. Completion status
    4. Location
    5. IP address
    6. Amount of usage
  6. Communications content: To enable you to send and receive communications via our platform, we need to be able to handle the content of the messages, calls, and other communication channels used by you. This includes, for example, voicemails and call recordings made via our services.
  7. Device information: Where we have provided end-user equipment to you or you have installed our software on your device, we collect device-specific information such as:
    1. Hardware model
    2. Operating system version
    3. Firmware
    4. Browser information
    5. Device and network configuration
    6. Device identifier
    7. IP address
    8. Device performance
    9. Signal strength
    10. Call quality
    11. Telemetry
    12. Mobile or wireless network information
  8. Contact lists and address book: If you use our mobile apps and grant permission, we may access and store the contact list or address book maintained on your mobile phone, tablet, or other broadband-connected devices.
  9. Mobile device camera, microphone, and photos: With your permission, we may access the camera, microphone, and photos on your mobile device to enable features such as making and receiving voice and video calls and sending photos.
  10. Location information: If your mobile device is equipped with GPS or can connect with wireless access points or hot spots, or if your mobile device communicates with cell towers or satellites, we may collect precise geographic location data.
  11. Genetic and Phenotypic Information:
    1. Genetic Information: With your consent, we may collect genotype information for Single Nucleotide Polymorphisms tested by Direct-To-Consumer genetic testing companies that have partnered with Limoverse.
    2. Phenotypic information: This includes observable traits such as morphological traits (height, eye/hair colour etc.), biochemical/biophysical properties (blood type, blood pressure etc.), or clinical information (absence/presence of diseases).

We use the information we collect for various purposes, which are detailed in the following sections of this Privacy Policy. If you have any questions about the information we collect or how we use it, please contact us using the information provided at the end of this Policy.

HOW DO WE COLLECT YOUR INFORMATION?

We collect information through various methods, including:

  1. Direct Interactions:

    1. When you create an account, fill out forms on our website, subscribe to newsletters, or interact with our customer support.
    2. When you participate in surveys, promotions, or provide feedback.
  2. Automated Technologies:

    1. Through cookies, web beacons, and similar tracking technologies when you interact with our website or mobile applications.
    2. Via server logs that record data about your device and internet connection when you access our services.
  3. Third-Party Sources:

    1. From social media platforms when you connect your account to our services.
    2. From our business partners and service providers who may share information about you with us.
  4. Google Health Connect: We collect health and fitness data through Google Health Connect, a secure platform that allows you to share data from various health and fitness apps with Limoverse. When you grant permission, Limoverse can access specific types of health data that you have chosen to share, such as active calories burned, distance travelled, elevation gained, exercise sessions, floors climbed, heart rate, hydration levels, nutrition information, oxygen saturation, respiratory rate, resting heart rate, sleep sessions, step cadence, step count, total calories burned, and weight records. This data is collected from other apps and devices you use, consolidated by Health Connect, and then shared with Limoverse based on your preferences. The frequency of data collection may vary depending on how often you sync your devices or use connected apps, but typically occurs in real time or when you open the Limoverse app. You have full control over what data is shared and can modify or revoke these permissions at any time through your device's Health Connect settings. It's important to note that while we can read this data when you grant permission, Limoverse does not have the ability to modify or delete data in your Health Connect app.

  5. Genetic and Phenotypic Data Collection: With your explicit consent, we may collect genetic and phenotypic data through our partnerships with Direct-To-Consumer genetic testing companies. This data is uploaded to the Limoverse blockchain and is considered proprietary to you, the user. It is only made available to entities you explicitly authorise.

WHY DO WE COLLECT YOUR INFORMATION AND HOW DO WE USE IT?

How we use the information we collect depends on which of our services you use, how you use them, and any preferences you have communicated to us. We collect and use your information for the following purposes:

  1. To Deliver Our Services:

    1. To process and fulfil orders, provide customer support, and send service communications.
    2. To authenticate your identity when you log in to our platform.
    3. To personalise your experience and provide content and features relevant to your interests.
  2. To Improve and Develop Our Services:

    1. To understand how users interact with our services and identify areas for improvement.
    2. To develop new features, products, and services.
    3. To conduct research and analysis aimed at enhancing our understanding of health and wellness trends.
  3. To Communicate with You:

    1. To respond to your inquiries, comments, and requests.
    2. To provide customer service and send you technical notices, updates, security alerts, and support and administrative messages.
    3. To send you marketing communications about our products, services, offers, promotions, and events.
  4. To Advertise and Market Our Services:

    1. To display ads for our services on other websites and applications.
    2. To measure the effectiveness of our advertising campaigns.
  5. For Compliance, Fraud Prevention, and Safety:

    1. To comply with legal obligations and respond to legal requests.
    2. To protect our, your, or others' rights, privacy, safety, or property.
    3. To detect, investigate, and prevent fraudulent transactions and other illegal activities.
  6. With Your Consent:

    For any other purpose disclosed to you in connection with our services, with your consent.

  7. Specifically for Health and Fitness Data: We use the health and fitness data collected through Health Connect to enhance your experience with Limoverse and provide you with comprehensive wellness services. Specifically, this data enables us to:

    1. Provide personalised health and wellness services: By analysing your activity levels, sleep patterns, nutritional intake, and other health metrics, we can offer tailored recommendations for exercise routines, meal plans, and lifestyle adjustments that are uniquely suited to your needs and goals.
    2. Track your progress: We use your historical data to monitor changes in your health and fitness over time. This allows us to celebrate your achievements, identify areas for improvement, and adjust your personalised plans as needed to ensure you're always moving towards your wellness goals.
    3. Generate comprehensive health insights: By combining different types of health data (such as correlating your sleep patterns with your daily activity levels), we can provide you with deeper insights into your overall health and well-being.
    4. Power our AI-driven health coach: Your data helps our AI systems provide more accurate and personalised coaching, offering real-time advice and motivation based on your current health status and historical trends.
    5. Enable community features: If you choose to participate, your anonymized data can contribute to community challenges and comparisons, fostering a supportive environment for achieving health goals.
    6. For Genetic and Phenotypic Data:
      1. To provide highly personalised health and wellness recommendations based on your unique genetic and phenotypic profile.
      2. To enable precision healthcare services through our platform.
      3. To facilitate research and development in personalised medicine and wellness, with your explicit consent.

We process this data in compliance with all applicable data protection laws and our robust security measures. You have control over your data at all times and can adjust what information is shared or revoke access through your account settings and, for Health Connect data, through your device's Health Connect settings.

WHO DO WE SHARE YOUR INFORMATION WITH AND WHY?

We may share your information in the following situations:

  1. Third-Party Service Providers: We share data with third-party vendors, consultants, and other service providers who need access to such information to carry out work on our behalf. These may include:

    1. Communications providers: To ensure your calls, messages, and other communications reach the intended recipients.
    2. Business operations vendors: For website and application development, hosting, maintenance, backup, storage, virtual infrastructure, payment processing, analysis, and other services. We only work with carefully selected vendors and require them to protect the confidentiality of shared information and use it solely for the purposes for which it was shared.
  2. Partners: If you purchase services offered by Limoverse or a partner through a special marketing arrangement, we may share your information with these third parties to assist with billing, collections, localised support, and customizations.

  3. Compliance with Laws and Law Enforcement:

    1. We may disclose your information as required by applicable law, regulation, legal process, or government request.
    2. We may also share information to protect Limoverse, our services, our customers, or the public from harm or illegal activities.
  4. Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  5. With Your Consent: We may share your information with third parties when you give us explicit consent to do so.

  6. Aggregated or De-identified Data: We may share aggregated or de-identified information that cannot reasonably be used to identify you.

  7. Public Forums: Information you post in public areas of our websites or services may be accessed, used, and stored by others around the world.

  8. Social Media Platforms: When you interact with our content on or through social media platforms, or if you use single sign-on features, both we and the relevant social media platform may have access to certain information about you and your use of both our platform and theirs.

  9. Other Users: When you use certain features like forums or chat functions, your information may be displayed to other users.

  10. Health Connect Data: We do not share your Health Connect data with third parties except as required to provide our services or as required by law.

  11. Genetic and Phenotypic Data: This data is considered proprietary to you and is only shared with entities you explicitly authorise.

In each case, we only share the information necessary for the purpose it's shared for. We do not sell your personal information to third parties.

HOW DO WE PROTECT YOUR INFORMATION?

At Limoverse, we implement a multi-layered approach to safeguard your personal data:

  1. Data Storage and Isolation: We store application data in a dedicated, isolated database system. This database is designed to exclude Personally Identifiable Information (PII) and personal identification details, minimising potential exposure. The database operates in a fully isolated environment with no external network connectivity, significantly reducing the risk of unauthorised access.

  2. Access Control: Access to the database is restricted exclusively to our application through robust authentication mechanisms. We employ industry-standard password hashing algorithms and enforce strict password policies to prevent unauthorised access attempts.

  3. Data Encryption: All data transmitted between our front-end applications and backend servers is encrypted using TLS 1.3 protocol. This ensures that information in transit is protected from interception and tampering.

  4. API Security: We utilise JSON Web Tokens (JWT) for API communication. JWTs provide a secure method of transmitting information between parties as a JSON object, ensuring the integrity and authenticity of the data exchanged.

  5. User Authentication: Our user authentication system employs multi-factor authentication options and session management to verify user identity and maintain secure connections throughout user interactions with our platform.

  6. Regular Security Audits: We conduct periodic security assessments and penetration testing to identify and address potential vulnerabilities in our systems.

  7. Employee Access Controls: We maintain strict access controls and data handling procedures for our employees, ensuring that only authorised personnel can access sensitive information on a need-to-know basis.

  8. Incident Response: We have a comprehensive incident response plan in place to quickly address and mitigate any potential security breaches.

  9. Data Minimisation: We collect and retain only the information necessary for the purposes identified in this privacy policy.

  10. Physical Security: Our servers and offices are protected by appropriate physical security measures.

While we implement these rigorous security measures, it's important to note that no system connected to the internet can guarantee 100% security. We encourage users to take personal responsibility for their account security by:

  1. Using strong, unique passwords for their Limoverse account
  2. Enabling multi-factor authentication when available
  3. Avoiding sharing account credentials
  4. Reporting any suspicious activity or potential security breaches immediately

By combining our robust security infrastructure with user vigilance, we strive to create a secure environment for all Limoverse users.

WHERE DO WE STORE/TRANSFER YOUR INFORMATION?

Personal information held by Limoverse is stored on and processed on computers situated in the UAE, India, and other jurisdictions. We and/or our service providers also process data in some other countries for customer care, account management, and service provisioning.

By using our services, you authorise the transfer of your information to the UAE, where we are based, and to other locations including India, where we and/or our service providers operate, and to its (and their) storage and use as specified in this Privacy Policy and any applicable terms of service or other agreement between you and Limoverse.

In some cases, Limoverse may seek specific consent for the use or transfer of your information overseas at the time of collection. If you do not consent, we may be unable to provide you with the services you requested. The countries where we operate may not have protections for personal information equivalent to those in your home country.

International transfers within Limoverse and its corporate affiliates: To facilitate our global operations, we transfer information among our corporate affiliates in countries whose privacy and data protection laws may not be as robust as the laws of the countries where our customers and users are based.

International transfers to third parties: Some of the third parties described in this Privacy Policy, which provide services to us under contract, are based in other countries that may not have equivalent privacy and data protection laws to the country in which you reside. When we share information with such third parties, we shall make use of legally recognized data transfer mechanisms, binding corporate rules for transfers to data processors, or other appropriate legal mechanisms to safeguard the transfer.

HOW LONG DO WE STORE YOUR INFORMATION?

We store your information until it is no longer necessary to provide the services or otherwise relevant for the purposes for which it was collected. This time period may vary depending on the type of information and the services used, as detailed below. After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.

We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our services. You cannot be identified from anonymized information retained or used for these purposes.

  1. Customer account information: We store your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the services. We also retain some of your information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, support business operations, and continue to develop and improve our services.

  2. Communications usage information: While you're an active customer, we retain the communications usage information generated by your use of the services until the information is no longer necessary to provide our services, and for a reasonable time thereafter as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our services.

  3. Marketing information, cookies and web beacons: If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our services, such as when you last opened an email from us or visited our websites. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.

  4. Device information: We collect device-specific information from you when we have provided end-user equipment to you or you have installed our software on your device. If you do not revoke our access to this information via the privacy settings on your device, we will retain this information for as long as your account is active.

  5. Health and fitness data collected through Health Connect: This data is retained for up to seven years after your Limoverse account turns inactive or until you revoke access, whichever comes first.

  6. Genetic and Phenotypic Information: This information is stored indefinitely on our blockchain platform, as it is considered proprietary to you. You have the right to request its deletion at any time.

HOW TO ACCESS AND CONTROL YOUR INFORMATION?

You have certain rights and choices regarding your personal information:

  1. Account Information: You can access, update, or delete your account information at any time by logging into your Limoverse account. If you need assistance, please contact us using the information provided at the end of this policy.

  2. Data Deletion: To request the deletion of your Limoverse account, please contact us. You should know that the deletion of your Limoverse account will result in you permanently losing access to your account and all customer data to which you previously had access through your account. Please note that certain data associated with that account may nonetheless remain on Limoverse's servers in an aggregated or anonymized form that does not specifically identify you. Similarly, data associated with your account that we are required by law to maintain will also not be deleted.

  3. Communication Preferences: You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, updating your email preferences within your Service account settings menu, or by contacting us as provided below to have your contact information removed from our promotional email list or registration database. Even after you opt-out from receiving promotional messages from us, you will continue to receive transactional messages from us regarding our services.

  4. Cookies and Tracking Technologies: Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our services.

  5. Health Connect Data: You can control what health and fitness data is shared with Limoverse through your device's Health Connect settings. You can revoke access at any time.

  6. Genetic and Phenotypic Data: You have full control over your genetic and phenotypic data. You can request its deletion at any time by contacting us.

  7. Do Not Track: Some browsers have incorporated "Do Not Track" (DNT) features. Because there is not yet a common understanding of how to interpret the DNT signal, our services do not currently respond to browser DNT signals.

  8. Your Rights: Depending on your location, you may have certain rights regarding your personal information, such as:

    1. The right to access personal information we hold about you
    2. The right to request correction or deletion of your personal information
    3. The right to restrict or object to our processing of your personal information
    4. The right to data portability

To exercise these rights, please contact us using the information provided at the end of this policy.

If you are an end-user of an application that uses Limoverse's services, you should direct requests for access and/or deletion of your data associated with that application to the relevant application provider in accordance with that application provider's own privacy policy.

APPROVED USE CASES

Limoverse is committed to using your data, including Health Connect data, responsibly and in accordance with applicable policies and regulations. We collect and process this data only for the following approved use cases:

  1. Fitness and Wellness: We use your health and fitness data to help you track your physical activity, monitor your progress, and achieve your wellness goals. This includes providing insights on your daily steps, calories burned, exercise sessions, and overall activity levels.

  2. Personalised Coaching: Your data enables us to offer tailored fitness coaching, including custom workout plans, activity recommendations, and progress tracking. Our AI-driven health coach uses this information to provide real-time advice and motivation.

  3. Health Monitoring: We analyse your health metrics such as heart rate, sleep patterns, and weight to provide you with a comprehensive view of your health status and trends over time.

  4. Nutritional Guidance: Based on your nutrition records and activity levels, we offer personalised dietary advice and meal planning suggestions to support your overall health and fitness goals.
