That's an assertion I added a few days ago, in that place it's impossible to have generic type arguments, but I was not thinking about constants. That's in thir.rs.

struct Foo<const N: u8>;

impl<const N: u8> Foo<N> {
    fn new() -> Self {
        Self
    }
}
