The differentiation between "And" and "Or" is that one is bold and blue. This could visually communicate that it's currently active, or that it's something the user can click on. Since neither option is made inactive and both options exist in the tabbing order, it's very difficult to tell which one is currently selected unless a screen reader is being used.
Recommended Fix
Use a visible radio-button, or toggle control which makes it clear control is the one that's currently active.
