If I understand what you want to do, you want to display only the first level of categories in the footer.
It is already like that.

with children is still there, just hidden with css.

By adding one setting we can control the footer category tree length.

As in the #9, you didn't modify any tpl files.
So, there is no front office modification.

There is modification, by setting the BLOCK_CATEG_MAX_DEPTH_FOOTER you change how deep the tree outputed by templates goes.
